gr. ............ ( hereinafter referred to as the Lender), acting as an individual, on the one hand, and the Limited Liability Partnership "....." (hereinafter referred to as the Lender) represented by the Director .............., acting on the basis of the Charter, on the other hand, collectively referred to as the Parties, and separately as the Party, have concluded this Agreement for the Gratuitous Use of Non-residential Premises (hereinafter referred to as the Agreement) as follows:

Subject of the agreement 1.1. The Lender undertakes to transfer the following property to the Borrower for temporary gratuitous possession and use: non–residential premises, Letter A, purpose kindergarten, with a total area of 528 sq.m., Letter B, purpose laundry with a total area of 74.1 sq.m., Letter C, purpose boiler room, with a total area of 35 sq. m. and a plot of land with a total area of 0.4144 Ha , located at: RK, Almaty region, Talgar district, village ........., St. .................. D. 98. Cadastral number №................ (hereinafter referred to as the Object of gratuitous possession and use). 1.2. The purpose and (or) purpose of using the Object is gratuitous possession and use – Kindergarten. 1.3. By signing the Agreement, the Lender confirms that the Object of gratuitous Use belongs to him by right of ownership on the basis of the purchase and sale agreement. 2. Terms of fulfillment of obligations 2.1. The property specified in clause 1 of this agreement must be transferred to the Lessee upon signing this agreement. 2.2. Start date gratuitous possession and use begins when the Lender transfers the Object of gratuitous use to the Recipient, namely: "24" April 20..., "End date of gratuitous use" - the date when the Recipient returns the Object of gratuitous use to the Lender, in connection with the expiration of the lease, namely "31" December 20....G. Term of gratuitous possession and use - which begins on the Date of commencement of gratuitous use and expires on the Date of termination of gratuitous possession and use.

3. Obligations of the parties 3.1. The Lender is obliged to: 3.1.1. Promptly transfer the property to the Lender in a condition that meets the terms of the Agreement. 3.1.2. Provide advisory and other assistance for the most efficient use of property. 3.2. The Borrower is obliged to: 3.2.1. Use the property in accordance with the terms of the Agreement and the purpose of the property. 3.2.2. To maintain the property in good condition, to carry out maintenance at their own expense. 3.2.3. To bear the costs of maintaining the property. 5.2.4. Other payments (water supply, energy supply, sanitation, communication services, Internet, garbage collection, heat supply, etc.) are carried out and paid at the expense of the Borrower. 3.2.5. Return the property to the Lender after termination of the Acceptance Certificate Agreement in the condition at the time of conclusion of the Agreement, taking into account normal wear and tear. 3.2.6. In case of damage to property, the Borrower undertakes to compensate for losses in accordance with the legislation of the Republic of Kazakhstan.

4. Liability of the Parties 4.1. This agreement is subject to early termination unilaterally by either Party if the other Party has committed gross or repeated violations of its terms. 4.1. If the premises fall into disrepair as a result of the actions of the Lender or failure to take necessary or timely measures, the Lender restores it on its own, at its own expense, or compensates for damage caused to the Lender in accordance with the procedure established by law. 4.2. Payment of fines, penalties, penalties and compensation for losses caused by non-fulfillment or improper fulfillment of contractual obligations does not release the Parties from fulfilling the terms of this agreement.

5. Force Majeure 5.1. Neither party shall be liable to the other party for fulfilling obligations under this Agreement due to circumstances beyond the will and desire of the parties that cannot be foreseen or avoided, including declared or actual war, civil unrest, epidemics, blockades, embargoes, earthquakes, floods, and other natural disasters. disasters. 5.2. A party that does not fulfill its obligations must notify the other party of the obstacle and its impact on the fulfillment of obligations under the Agreement.

6. Dispute Resolution Procedure 6.1. All disputes or other disagreements arising between the parties under or in connection with this Agreement shall be resolved through negotiations between the parties. 6.2. If it is impossible to resolve disagreements through negotiations, they are subject to consideration in court in accordance with the procedure established by law.

7. Procedure for amendments and additions to the Agreement 7.1. Any amendments and additions to this Agreement are valid only if they are made in writing and signed by both parties. 7.2. Early termination of the Agreement may take place by agreement of the parties or on the grounds provided for by the civil legislation in force in the Republic of Kazakhstan, with compensation for losses incurred. 8. Other terms 8.1. This Agreement is drawn up in two copies having the same legal force, one copy for each of the parties.
